Terms & Conditions
Definitions
For the purposes of these Terms, the following definitions apply:
- "Website" means the site available at cocoa-aussie.com, including all sub-pages, content, and services marketed as Cocoa.
- "Operator" means SSC Entertainment N.V., a private limited liability company incorporated in Curaçao, with registered and legal address at Heelsumstraat 51, E-Commerce Park, Curaçao, which operates the Cocoa brand via cocoa-aussie.com under a claimed Curaçao license 8048/JAZ issued by Antillephone N.V. (public verification reported as intermittent and not reliably available).
- "Brand" or "Cocoa" refers to the online gambling brand "Cocoa" as presented exclusively on cocoa-aussie.com.
- "User" or "Player" means any natural person who accesses the Website, creates an account, or participates in any gambling activity or promotion offered via Cocoa on cocoa-aussie.com.
- "Account" means a personal user profile registered on the Website, enabling the User to deposit funds, place Bets, participate in games, and receive withdrawals.
- "Bet" or "Wager" means any amount of real money or bonus funds staked by a User on the outcome of a casino game or other gambling product offered on the Website.
- "Bonus" means any promotional benefit (including bonus funds, free spins, cashback, or other incentives) credited to a User's Account subject to specific conditions, including wagering requirements and time limits.
- "Real Money Balance" means the portion of funds in a User's Account that has been deposited by the User and is not subject to ongoing wagering requirements.
- "Bonus Balance" means funds, free spins, or other promotional value granted by the Operator which may be subject to wagering, game restrictions, and withdrawal limitations.
- "KYC" (Know Your Customer) means the verification processes applied by the Operator to confirm a User's identity, age, place of residence, and source of funds.
- "Prohibited Jurisdiction" means any country or territory where online gambling through this Website is illegal or where the Operator chooses not to offer services. For Australian Users, the Operator's offering is illegal under the Interactive Gambling Act 2001 (Cth) and is subject to Australian Communications and Media Authority (ACMA) blocking requests, including ACMA2023/567.
- "Games" means the online casino games and related gambling products provided on the Website, including titles and platforms supplied by Rival, Betsoft, Saucify and other providers, using random number generators (RNGs) certified at provider level, but not subject to publicly available monthly third-party audits for this specific casino implementation.
- "Interactive Gambling Act" means the Interactive Gambling Act 2001 (Cth) of Australia, as amended from time to time.
- "ACMA" means the Australian Communications and Media Authority, the regulator responsible for enforcing the Interactive Gambling Act 2001 in Australia.
Regional Compliance Note: For residents of Australia, the Operator is classified by ACMA as providing illegal offshore gambling services and is the subject of blocking requests (including ACMA2023/567). Players are not criminally penalised under Australian law for using such services, but they have little or no protection under Australian consumer law and limited or no practical legal recourse against the Operator.
Account Registration
Eligibility and Age Requirements
- Minimum age: You must be at least 18 years old to register and use an Account. The Operator may at any time request documentary proof of age. If you are under 18, you must not access or use the Website.
- Jurisdictional restrictions: It is your sole responsibility to ensure that accessing and using Cocoa via cocoa-aussie.com is lawful in your jurisdiction. For residents of Australia, the services offered by the Operator are illegal for the Operator to provide under the Interactive Gambling Act 2001, and are subject to ACMA blocking requests. By registering, you expressly acknowledge that:
- you may have no remedies under Australian consumer law;
- the Operator is effectively unregulated from an Australian law perspective; and
- you accept all risks associated with using offshore gambling services.
Account Creation Process
- Registration form: To open an Account, you must provide truthful, complete, and current information, including your full name, date of birth, residential address, email address, and chosen login credentials.
- Email verification: After submitting the registration form, you may be required to verify your email address by clicking a confirmation link sent to the email you provided. Accounts may remain inactive or restricted until verification is completed.
- KYC procedures: Before enabling deposits, gameplay, or withdrawals, the Operator may conduct KYC checks, which may include:
- copy of a valid government-issued photo ID (passport, national ID card, driving licence);
- proof of address (utility bill, bank statement not older than 3 months);
- proof of payment method ownership (redacted bank/statement, card copy showing only permitted digits); and
- additional documentation relating to source of funds or source of wealth, if deemed necessary.
User Obligations
- Accuracy of data: You must ensure that all registration details and documents are accurate, genuine, and kept up to date. Providing false or misleading information constitutes a serious breach of these Terms and may result in Account closure and forfeiture of winnings.
- One account only: You may hold only one Account with Cocoa on cocoa-aussie.com. Multiple Accounts, shared Accounts, or Accounts opened on behalf of third parties are strictly prohibited.
- Password security: You are solely responsible for maintaining the confidentiality of your login credentials. You must:
- choose a strong password that is not reused on other services;
- not share your credentials with any third party; and
- immediately inform the Operator at [email protected] if you suspect unauthorised access to your Account.
- Personal use only: Your Account is for your personal, non-commercial use. You must not use the Website on behalf of any third party, or for any unlawful or fraudulent purpose, including money laundering or terrorist financing.
- Self-exclusion and limits: Where available, you are encouraged to apply deposit limits, loss limits, or self-exclusion tools offered on the Website. However, as the Casino operates under offshore regulation, responsible gambling protections may not be equivalent to those required under Australian law.
Betting & Gameplay Rules
General Betting Rules
- Game rules: Each Game has specific rules and pay-tables, which form part of these Terms. By placing a Bet, you acknowledge that you have read and understood the relevant game rules.
- Minimum and maximum stakes: Minimum and maximum Bet amounts are determined per Game and may vary by currency, table, or player status. Applicable limits are displayed within each Game interface and may be changed by the Operator at any time.
- Bet validity: A Bet is deemed placed when it is accepted by the Operator's servers and recorded in the transaction log. Once accepted, the Bet is final and cannot normally be cancelled or changed by the User.
- RNG and fairness: The outcome of most Games (excluding live dealer streams) is determined by random number generator (RNG) technology provided by certified suppliers (including Rival, Betsoft, and Saucify). While game providers have obtained certifications, the specific implementation on cocoa-aussie.com is not subject to publicly available monthly audits (e.g. eCOGRA). You accept that your only evidence of game outcomes is the data retained on the Operator's servers.
Cancellation and Modification of Bets
- User-initiated changes: Once you confirm a Bet, you cannot withdraw, cancel, or amend it, unless explicitly allowed by the specific Game before the betting round closes.
- Operator-initiated voiding: The Operator reserves the right, in its sole discretion, to void or cancel Bets and/or adjust balances if:
- a Game malfunctions or displays an obvious error (including software bugs, incorrect pay-tables or misconfigured odds);
- a Bet is accepted after the outcome is known or should reasonably have been known; or
- there is evidence or reasonable suspicion of fraud, collusion, use of automated tools, or other prohibited behaviour.
Conduct in Live Casino, Chats and Community Features
- Respectful behaviour: You must behave respectfully in all live dealer environments, chats, and community features. In particular, you must not:
- use abusive, racist, sexist, homophobic, or otherwise offensive language;
- harass, threaten, or insult other players, dealers, or staff; or
- promote illegal activities or share sexually explicit or violent content.
- Anti-fraud and collusion: You must not:
- collude with other players to gain unfair advantage;
- manipulate games or exploit bugs, latency, or obvious errors;
- use bots, scripts, or other automated systems; or
- engage in chargeback abuse, money laundering, or other financial crime.
- Content ownership: Any text or content you submit in chats or elsewhere may be recorded, monitored, and retained by the Operator. The Operator may remove content at its discretion and may suspend chat access or Account access for breaches.
Bonus Terms
Bonus Activation
- Eligibility: Bonuses and promotions offered on Cocoa via cocoa-aussie.com are subject to individual eligibility criteria, which may include geographic restrictions, minimum deposits, or specific payment methods. The Operator may exclude residents of certain Prohibited Jurisdictions from promotions at its discretion.
- Activation conditions: To activate a Bonus you may need to:
- enter a promotional code during registration or deposit;
- opt in via the promotions page or cashier; and/or
- make a qualifying deposit meeting the stated minimum amount.
Wagering Requirements and Timeframes
- Wagering multiplier: Unless otherwise indicated, Bonuses are subject to wagering requirements expressed as a multiple of the Bonus amount and/or deposit (e.g. 40x Bonus). The specific requirement will be stated in the promotion details and may differ per offer.
- Contribution of games: Not all Games contribute equally (or at all) towards wagering. Typical contribution structures may include:
- most video slots: 100% of stake;
- table games, video poker, live casino: 0 - 20% of stake; and
- certain low-risk bets or excluded games: 0% of stake.
- Time limits: Bonuses must usually be wagered within a fixed period (for example, 7 - 30 days) from the time of credit. After the expiry period, any remaining Bonus Balance and related winnings may be forfeited at the Operator's discretion.
Prohibited Games and Actions
- Game restrictions: Certain Games may be excluded from Bonus play, or may be subject to reduced contribution. Playing excluded games with an active Bonus, even unintentionally, may lead to removal of the Bonus and associated winnings.
- Betting patterns: The following actions are generally prohibited when using Bonus funds and may result in forfeiture of the Bonus and related winnings:
- placing single Bets that exceed the maximum allowed Bonus Bet (as stated in the promotion or general Bonus rules);
- "low-risk" or "even-money" betting strategies designed to clear wagering with minimal risk;
- systematic bets that significantly shift risk after achieving a large win; and
- delaying bonus rounds or free games to a time where no wagering requirement applies.
Combining Promotions and Bonus Abuse
- No automatic combination: Unless explicitly stated, different promotions and Bonuses cannot be combined. You may usually have only one active Bonus at any time per Account, household, IP address, or device.
- Multiple Accounts and abuse: Opening multiple Accounts, using disposable email addresses, VPNs, or identity masking tools to claim repeated Bonuses, or otherwise abusing promotional offers is strictly prohibited. The Operator may:
- cancel current and future Bonuses;
- void winnings derived from Bonus abuse; and
- close related Accounts and withhold funds where there is evidence of fraud or collusion.
- Bonus amendments: The Operator may modify, suspend, or withdraw any promotion at any time, provided that such change does not adversely affect Bonuses already accepted by Users in a manner that would be unfair or unreasonable in the circumstances.
Payments & Withdrawals
Deposit Methods
- Accepted methods: Subject to availability in your jurisdiction, the Website may enable deposits via:
- credit and debit cards;
- e-wallets;
- bank transfers; and
- selected cryptocurrencies or other alternative payment methods.
- Ownership of payment method: You must use only payment methods that are registered in your own name. Use of third-party cards, wallets, or bank accounts is prohibited and may trigger additional KYC checks, Account suspension, or transaction reversal.
- Deposit limits and fees: Minimum and maximum deposit limits apply per transaction and/or per day and are displayed in the cashier. The Operator may charge fees for certain deposit methods; any such fees will be notified before you confirm the transaction. Your bank, card issuer, or wallet provider may charge additional fees or currency conversion charges that are outside the Operator's control.
Withdrawals
- General conditions: Withdrawals are subject to:
- successful completion of KYC checks;
- the availability of sufficient cleared Real Money Balance;
- compliance with wagering requirements and Bonus Terms; and
- absence of suspected fraud, money laundering, or other prohibited conduct.
- Methods and "closed loop" policy: Wherever possible, withdrawals will be processed via the same method and to the same account used for deposit (closed-loop policy). If this is not possible, the Operator may request an alternative method and additional proof of ownership.
- Limits and processing times: The Operator may apply daily, weekly, or monthly withdrawal limits. Indicative internal processing times are typically between 24 hours and 7 business days after approval of all KYC checks, but may be longer depending on volume or complexity. External payment providers and banks may add additional processing time, which is beyond the Operator's control.
- Fees: The Operator may charge reasonable withdrawal fees, particularly for small withdrawals, repeated withdrawals within short periods, or international transfers. Any applicable fee will be displayed or otherwise communicated before the withdrawal is confirmed.
Refunds, Chargebacks and Reversals
- Refund policy: Deposits are not normally refundable once used or staked. The Operator may, at its discretion, consider a refund request where no gaming activity has taken place, subject to the deduction of any administrative or payment processing costs.
- Chargebacks: If you initiate a chargeback or payment dispute, the Operator may:
- immediately suspend or close your Account;
- void Bets and confiscate winnings associated with the disputed funds; and
- recover any costs incurred as a result of the chargeback, including through third-party collection agencies.
- Bonus refunds: If a refund is granted in relation to a deposit that triggered a Bonus, the Operator may cancel the associated Bonus and remove any winnings generated from that Bonus where appropriate.
Regional Compliance Note: For Australian Users, transactions with cocoa-aussie.com involve an offshore provider not licensed in Australia. You may not have access to Australian-based dispute resolution, chargeback support practices may differ from Australian norms, and you are unlikely to have effective legal recourse under Australian law for unpaid withdrawals or disputed transactions.
Limitation of Liability
Operator's Obligations
- Provision of services: The Operator endeavours to provide access to the Website and Games on a continuous basis and to maintain reasonable technical and security standards. However, the services are offered "as is" and "as available", and no guarantee is given that access will be uninterrupted, timely, or error-free.
- Accuracy of results: The Operator seeks to ensure that game outcomes, Bet settlements, and Account balances are recorded accurately based on data stored on its servers. In the event of discrepancies between your display and the Operator's logs, the data maintained by the Operator shall prevail.
Exclusions of Liability
- Technical failures: To the maximum extent permitted by applicable law, the Operator is not liable for any loss or damage arising from:
- technical failures, delays, or interruptions of the Website or Games;
- network or internet outages, latency, or routing issues (including issues caused by ACMA-ordered DNS/IP blocking or circumvention tools such as VPNs);
- hardware, software, or device incompatibility; or
- errors or omissions in content, including obvious typographical or configuration errors.
- Indirect losses: The Operator is not liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits, loss of data, or loss of opportunity, whether arising in contract, tort, or otherwise.
- Regulatory and jurisdictional risks: For residents of Australia and other Prohibited Jurisdictions, you acknowledge that:
- the service is offered in breach of local law by the Operator, not by you;
- you may have no practical legal recourse through local courts or regulators; and
- any recourse you may have is limited to the laws and courts of Curaçao or other jurisdictions designated by the Operator. The Operator expressly disclaims liability under Australian consumer and gambling laws to the fullest extent legally permissible.
Maximum Liability
- Cap on liability: Without prejudice to the foregoing, where the Operator is found liable to you in connection with a Bet or Game outcome, its maximum aggregate liability shall not exceed:
- the amount of the Bet or Wager placed on the Game which gave rise to the liability; or
- where the claim does not relate to a specific Bet, the lesser of your net deposits over the preceding 30 days and AUD 1,000 (or currency equivalent),
- Consumer-specific rights: Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded under the law that is mandatorily applicable to you. However, for Australian Users, you acknowledge that such mandatory rights are unlikely to be enforceable in practice against the offshore Operator.
Intellectual Property Rights
- Ownership: All intellectual property rights in and to the Website, including but not limited to text, graphics, logos, designs, user interfaces, software, underlying code, and game titles, are owned by the Operator, its group companies, or its licensors (including Rival, Betsoft, Saucify and other providers).
- Limited licence: You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and Games for personal, non-commercial entertainment purposes only, strictly in accordance with these Terms.
- Prohibited uses: You must not, without prior written consent of the Operator:
- copy, reproduce, modify, adapt, translate, distribute, publish, or create derivative works from any content or software on the Website;
- reverse engineer, decompile, disassemble, or otherwise attempt to access the source code of any software used on the Website, except to the extent expressly permitted by applicable law;
- frame, mirror, or scrape the Website or any part of it; or
- use any automated tool (including robots, spiders, or crawlers) to access the Website for any purpose other than legitimate indexing by public search engines.
- Trademarks: All trademarks, service marks, and trade names displayed on cocoa-aussie.com in connection with Cocoa are the property of their respective owners. No licence or right is granted in respect of any such marks without express written permission.
Privacy & Data Protection
The collection and processing of your personal data in connection with your use of Cocoa via cocoa-aussie.com are governed by the Operator's separate Privacy Policy, as amended from time to time.
- You acknowledge that by creating an Account and using the Website, you have read and understood the applicable Privacy Policy and consent to the collection, use, storage, and disclosure of your information in accordance with that policy.
- The Operator implements reasonable technical and organisational measures (including the use of SSL encryption via Cloudflare) to protect your personal and financial data; however, no system is completely secure, and the Operator cannot guarantee absolute security.
- Because the Operator is based in Curaçao and uses international payment processors and service providers, your data may be transferred to and processed in countries that may not provide the same level of data protection as your home jurisdiction, including Australia. By using the Website, you agree to such cross-border transfers.
Changes to Terms
- Right to amend: The Operator may modify, update, or replace these Terms at any time to reflect changes in legal, regulatory, technical, or business circumstances.
- Notification: Material changes will normally be notified by one or more of the following methods:
- publishing the updated Terms on cocoa-aussie.com with a new effective date;
- displaying an in-site banner, pop-up, or message on login; or
- sending an email to the address registered in your Account.
- Acceptance of changes: Continued use of the Website or your Account after the effective date of the updated Terms constitutes your acceptance of those changes. If you do not agree with any modification, you must stop using the Website and may request closure of your Account.
Termination & Suspension
Operator's Right to Suspend or Terminate
- Grounds: The Operator may suspend or close your Account, void Bets, and withhold funds (subject to applicable law) if:
- you breach any provision of these Terms or applicable Bonus rules;
- you provide false, misleading, or incomplete information;
- you fail KYC or source-of-funds checks, or do not provide requested documents;
- there is reasonable suspicion of fraud, collusion, money laundering, or other criminal activity;
- your gambling behaviour raises responsible gambling concerns and the Operator reasonably considers that continued use may cause you serious harm; or
- the Operator decides, for business, legal, or regulatory reasons (including ACMA enforcement actions in Australia), to discontinue providing services to you or in your jurisdiction.
- Effect of termination: Upon Account closure:
- your right to access the Website and place Bets immediately ceases;
- any active Bonuses may be forfeited; and
- subject to KYC and anti-fraud checks, any remaining Real Money Balance may be paid out to you, less any amounts owed to the Operator (such as chargeback costs or fraud-related losses).
User-Initiated Closure
- Voluntary closure: You may request closure of your Account at any time by contacting customer support at [email protected]. The Operator may require you to confirm your identity before processing the request.
- Refund of funds: On voluntary closure, the Operator will, subject to KYC verification and the absence of any breach, pay out any remaining Real Money Balance via an agreed method. Any Bonuses and associated winnings not yet converted to Real Money Balance will be forfeited.
Notification
- Notice to User: Where legally required or reasonably practicable, the Operator will notify you by email or on-site message of the suspension or closure of your Account and the main reason for such action. However, the Operator may be prohibited from disclosing details where investigation of fraud or criminal activity is ongoing.
Governing Law & Jurisdiction
- Governing law: These Terms and any dispute arising out of or in connection with your use of the Website shall, subject to any mandatory provisions of law that cannot be excluded, be governed by and construed in accordance with the laws of Curaçao.
- Jurisdiction: You agree that, subject to any applicable alternative dispute resolution mechanism prescribed by the Operator or its licensors, the courts of Curaçao shall have exclusive jurisdiction to hear and determine any dispute arising from or related to these Terms, your Account, or your use of the Website.
- Arbitration: The Operator may, at its discretion, require that certain disputes be referred to binding arbitration in Curaçao or another agreed forum, under rules and procedures notified to you at the time a dispute arises. Any arbitration shall be conducted in English.
Regional Compliance Note (Australia): For Australian Users, the Interactive Gambling Act 2001 prohibits the Operator from offering many of the services provided on cocoa-aussie.com, and ACMA has issued blocking requests (including ACMA2023/567) targeting the Operator's domains. While players are not criminally penalised for accessing such offshore sites, you acknowledge that:
- you have no meaningful recourse under Australian courts or regulators against the Operator;
- any dispute must be pursued, if at all, under Curaçao law and jurisdiction; and
- recovery of funds or enforcement of judgments against the Operator may be difficult or impossible in practice.
